Eligibility and Qualifications
Experience:
- The Shariah scholar must have at least four (4) years’ experience in giving Shariah rulings, including the period of Takhassus fil Ifta; OR at least five (5) years post-qualification experience in teaching or Research and Development in Islamic Banking and Finance. Preference shall be given to those who have a certificate in Takhassus fil Fiqh/Takhassus fil Ifta.
- Preference may be given to a Shariah Scholar who has at least three (3) years’ experience as a Shariah Advisor or Member of SB of any Islamic Financial Institution (IFI) or deputy to a Shariah Advisor or member of the Shariah Team of an IFI.
- Adequate understanding of banking and finance in general and Islamic finance in particular.
- Adequate understanding of Fiq ul Muama’alat and Shariah related issues.
- Strong understanding of Islamic jurisprudence (Usul al-Fiqh) and Fiqh methodologies for deriving juristic opinion.
Qualification:
- Shahadat ul Aalamiyyah (شهادة العالمية) Degree (Dars e Nizami) or similar other degree from any recognized institution/Board of Madaris AND Bachelor’s Degree (which is other than the Madaris Degree). OR
- Post Graduate Degree in Kuliyyatush Shariah (كلية الشريعة) or Kuliyyah Usooluddin (كلية أصول الدين) L.L.M. (Shariah) or equivalent from any recognized University. OR
- Shariah Scholar members of Shariah Board/Committees of internationally reputed organizations operating in other jurisdictions.
Job Responsibilities
The Resident Shariah Board Member (RSBM) will be responsible for the following duties:
- Provide explanation/clarification to management and staff of IBI on products, documents, process flows, and other operational Shariah related matters, in light of decisions, rulings, and fatawa already issued by the SB.
- Ensure that management provides all necessary information, details, and documents when seeking explanation/clarification from the RSBM, to enable proper understanding of the product, its process flows, business and economic outcomes, and Shariah permissibility or impermissibility.
- Guide the SCD (Shariah Compliance Department) in conducting Shariah compliance reviews of key business areas on a test check basis.
- Review responses to Shariah related queries of IBI’s clients regarding IBI’s products and services as submitted by SCD.
- Facilitate the SCD and Training Department in designing and conducting training activities.
- Submit at least a quarterly report to the SB for ratification of all material explanations/clarifications provided by him/her on products, services, documents, process flows, and other operational Shariah related issues, in light of decisions, rulings, and fatawa already issued by SB.
